2. Arrest made in Albany, Georgia hit and run death
Albany, GA police have arrested 33-year old Terry Roberson. He has been charged him with vehicular homicide in the hit and run auto accident death of 66-year old Roosevelt Coley. Roberson hit Coley and was killed while crossing Oglethorpe at Jefferson Street in January, 2010. Warrants are also out for Antwan Fields for obstruction of justice. Police say he owned one of the second car that hit Coley.

3. Augusta woman hits 3 vehicles
10 traffic charges are facing an Augusta, Georgia woman. Richmond County Deputies say she hit three cars, in two separate accidents on Gordon Highway. Reports indicate 46 year old Barbara Brooker was driving the wrong way down the 1600 block of Gordon Highway. She first sideswiped a taxi. She and another driver were taken to the hospital with non life threatening injuries. When Brooker recovers, deputies will transport her to the Richmond County Jail. Wakulla County Sheriff’s Office investigators have arrested a 43-year-old Michael Timothy Lilliman of Crawfordville on a DUI and hit and run Monday, March 29 at 10:47 p.m. According to Sheriff David Harvey he will also face hit-and-run and leaving the scene of an accident charges. A hit and run auto accident suspect,Tony Tripoldi, 35, of Springfield, Georgia was charged with two counts of failure to notify owner after striking two unattended vehicles. Shortly after midnight on June 19, 2010 deputies responded to the Chevron gas station on Highway 21 at Highway 275 on a report of a hit and run. Store surveillance shows Tripoldi making a purchase, got into his vehicle, and struke two parked cars before fleeing the scene.

A man who was struck by a hit and run driver while riding his bicycle on Skipperton Road last month has died, according to the Bibb County Sheriff’s Office. Now, deputies say the man who hit him faces homicide charges. The Bibb County Sheriff’s Office says 37-year-old Myrtis Green was charged with serious injury by vehicle in May when his car hit 26-year-old Elbert Banks III while Banks was riding his bike on Skipperton Road. 14. Hit-and-run kills Colquitt County man in Sylvester
Sylvester, Georgia: A Colquitt County man died in an early morning hit-and-run accident in Sylvester. Jordan Taylor Hicks, 26, was killed by a motorist who later abandoned the vehicle, Worth County, Georgia Coroner John Johnson said. The accident occurred at about 3 a.m. on Georgia Highway 33 South. The fatality was the second in as many weeks in the city. “As far as I know he (Hicks) was with a group; he had to get out to urinate,” Johnson said. “He thought he was off the highway a little farther than he was. When he was walking to the back of the car that other car came by and clipped him.” The car that struck Hicks, a new Dodge Magnum that had been purchased recently in Thomasville, was found abandoned a few miles outside Sylvester on the same roadway. A man now charged in a hit-and-run accident that killed a 4-year-old Marietta, Georgia boy Saturday night served prison time after being charged in two hit-and-run auto wrecks that occurred on the same day 13 years ago. One of the wrecks happened on Austell Road, about three miles from the spot where A.J. Newman was killed Saturday. Cobb County police records show Jerry L. Guy rear-ended a car Feb. 17, 1997, on Austell Road at Pair Road. Guy drove away and later ran into another car on Smyrna-Powder Springs Road, injuring two people. Police said he fled on foot. He pleaded guilty to several charges and was sentenced in June 1998 to two years in prison and three years on probation. No one was killed in the 1997 wrecks.

16. IDs released of 2 killed when car crashed into Englewood pond
Two people who died after being pulled by firefighters from a car that plunged into a retention pond in Englewood have been identified. Bryon Thompson, 27, and Alyssa Cutting, 23, both of Denver, died Saturday, according to a media release from the Englewood Fire Department. The two were taken to Swedish Medical Center after their Subaru plunged into the water at high speed about 1:45 a.m. Saturday. When firefighters arrived, after Englewood dispatch received a 911 call about the accident, the car was submerged in the pond.

17. Man flees scene of wreck in Walker County; manhunt under way
A hit-and-run auto accident on U.S. 27 Monday morning left one driver seriously injured and police combing nearby woods for another driver who fled the scene. At 6:49 a.m., the Georgia State Patrol received a call that a Lexus with Hamilton County, Tenn., plates collided head-on with an Oldsmobile Cutlass Ciera. The Lexus was traveling north in the southbound lanes of Hwy. 27, according to Master Trooper Bowman with Georgia State Patrol, the officer in charge on the scene. The driver of the Lexus left the vehicle and tried to pry off his own license plate before fleeing into the nearby woods. 18. Man still recovering after hit and run
In the early morning hours of June 15, James Gnatt, 72, was struck by a car and left, badly injured, in the middle of Hodgson Memorial Drive. According to an eye witness who stopped to help him, Gnatt’s left arm was mangled, and he had several broken ribs. In addition, he was losing blood rapidly and might not have survived if someone hadn’t stopped to help. Three weeks later, and the driver who hit Gnatt still has not been found. Instead, Gnatt is left with mounting medical bills, further procedures for his arm and months of rehab. Atlanta Metro Police are investigating the incident, and Crimestoppers says it’s offering a reward to anyone who can provide information leading to an arrest.

Parents of teen told daughter died in car accident found alive in hospital 6 days later

Last July 18, 2010, five high school friends from Glendale, AZ were involved in a tragic car accident while traveling home from Disneyland in California. One of the rear tires of the sports utility vehicle they were driving, blew out and the SUV turned over. Marlena Cantu and April Guerra were among the five passengers. One of them would survive the crash, the other would not. But which of them survives? It appears the authorities and/or the hospital mixed up the identities of the teens. The family of Guerra, 21, was told she died at the scene. Her family started mourning for her loss and making arrangements for her funeral. Friends and other family members flew to Phoenix for the day that Guerra was supposed to be laid to rest. Meanwhile, Cantu’s family was told that Marlene has sustained extensive injuries with her brain and back and was in a critical condition. Six days later would prove to be a day that would give both families the shock of their lives. The identity of the two girls has been mixed up. At least 555 people including 111 children, died riding all-terrain vehicles in 2006, according to a government report released. This report is from Consumer Affairs. In 2007 there were 699 deaths and 150,900 visits to the emergency room for ATV related trauma. 2008 showed a sharp decline with 410 deaths and 135,100 visits to the emergency room.


SALEM, AL (WTVM) – Alabama State Troopers and the Public Safety office are investigating the crash of a 4-wheeler. It happened Tuesday night off Lee Road 252, right off 254 in the Salem, AL community. Seventeen-year-old Amanda Johnson and 18-year-old Justin Stokes were allegedly thrown from an ATV after it flipped. It’s believed Johnson called police, who rushed to the scene to find both teens injured. All factors that could lead to impaired driving are being considered in the case. Lee County Sheriff Jay Jones says, “The male had suffered some pretty significant trauma to the head and as a result of that we contacted the Life Flight helicopter emergency transport service and he was airlifted by helicopter to the Columbus Medical Center in Columbus. The female that was on the ATV was transported by ambulance to the medical center as well.” Johnson is no longer at the hospital. As of 4:30 p.m.Thursday, Stokes is still in critical condition. His family says he is fighting and they are asking the community for prayers. Investigators believe the serious injuries were a result of the two not wearing helmets.

The Criminal Justice Academy in Columbia staged a crash between two cars. A Nissan was stopped, while a Ford Crown Victoria, a former police cruiser, slammed into the driver’s door. There was no one in the Nissan, which is a good thing since the Ford pushed the side of the Nissan’s door past where the driver’s seat was.

Motor vehicle accident reconstruction science and Georgia law

Vehicular accident reconstruction is the scientific process of investigating, analyzing, and drawing conclusions about the causes and events during a vehicle collision. Reconstructionists are employed to conduct in-depth collision analysis and reconstruction to identify the collision causation and contributing factors in different types of collisions, including the role of the driver(s), vehicle(s), roadway and the environment. The laws of physics and engineering principles such as the conservation of linear momentum, work-energy methods, and kinematics are the basis for these analysis and may make use of software to calculate useful quantities. The accident reconstruction provides rigorous analysis that an expert witnesses can present at trial. Accident reconstructions are done in cases involving fatalities, and often when personal injury is involved. Results from accident reconstructions are also useful in developing recommendations for making roads and highways safer, as well as improving safety aspects of motor vehicle designs. These reconstructions are often conducted by forensic engineers, specialized units in law enforcement agencies, or private consultants.


The use of graphic representation or even video reconstruction can be helpful in demonstrating the details of how an accident transpired.

As an Atlanta accident attorney it is sometimes necessary to consult the services of an expert in accident reconstruction. These experts can provide expert testimony as to the cause(s) of an accident including who was at fault. Georgia law states:

40-6-270.
(a) The driver of any vehicle involved in an accident resulting in injury to or the death of any person or in damage to a vehicle which is driven or attended by any person shall immediately stop such vehicle at the scene of the accident or shall stop as close thereto as possible and forthwith return to the scene of the accident and shall:
(1) Give his name and address and the registration number of the vehicle he is driving;
(2) Upon request and if it is available, exhibit his operator´s license to the person struck or the driver or occupant of or person attending any vehicle collided with; and
(3) Render to any person injured in such accident reasonable assistance, including the transporting, or the making of arrangements for the transporting, of such person to a physician, surgeon, or hospital for medical or surgical treatment if it is apparent that such treatment is necessary or if such transporting is requested by the injured person.
The driver shall in every event remain at the scene of the accident until fulfilling the requirements of this subsection. Every such stop shall be made without obstructing traffic more than is necessary.
(b) If such accident is the proximate cause of death or a serious injury, any person knowingly failing to stop and comply with the requirements of subsection (a) of this Code section shall be guilty of a felony and, upon conviction thereof, shall be punished by imprisonment for not less than one nor more than five years.
(c)(1) If such accident is the proximate cause of an injury other than a serious injury or if such accident resulted in damage to a vehicle which is driven or attended by any person, any person knowingly failing to stop or comply with the requirements of this Code section shall be guilty of a misdemeanor and:
(A) Upon conviction shall be fined not less than $300.00 nor more than $1,000.00, which fine shall not be subject to suspension, stay, or probation, or imprisoned for up to 12 months, or both;
(B) Upon the second conviction within a five-year period of time, as measured from the dates of previous arrests for which convictions were obtained to the date of the current arrest for which a conviction is obtained, shall be fined not less than $600.00 nor more than $1,000.00, which fine shall not be subject to suspension, stay, or probation, or imprisoned for up to 12 months, or both; and for purposes of this subparagraph, previous pleas of nolo contendere accepted within such five-year period shall constitute convictions; and
(C) Upon the third or subsequent conviction within a five-year period of time, as measured from the dates of previous arrests for which convictions were obtained to the date of the current arrest for which a conviction is obtained, shall be fined $1,000.00, which fine shall not be subject to suspension, stay, or probation, or imprisoned for up to 12 months, or both; and for purposes of this subparagraph, previous pleas of nolo contendere accepted within such five-year period shall constitute convictions.
(2) For the purpose of imposing a sentence under this subsection, a plea of nolo contendere shall constitute a conviction.
(3) If the payment of the fine required under this subsection will impose an economic hardship on the defendant, the judge, at his sole discretion, may order the defendant to pay such fine in installments and such order may be enforced through a contempt proceeding or a revocation of any probation otherwise authorized by this Code section.
(d) Notwithstanding the limits set forth in any municipal charter, any municipal court of any municipality shall be authorized to impose the punishments provided for in this Code section upon a conviction of violating this Code section or upon conviction of violating any ordinance adopting the provisions of this Code section.

Georgia personal injury law applies to all accidents involving motor vehicles, even single car motor vehicle accidents. A Toyota driver said her car accelerated out of control before plunging through a wall of her home Wednesday. Gwinnett firefighters responded to the accident at a home in the 3200 block of Cobblers Walk in Loganville. When they arrived, they found a Toyota Camry partially out of the back wall of a house. The incident occurred just before 8 p.m. The driver of the Camry told firefighters she was pulling into her garage when the vehicle accelerated forward out of control. It went through the closed garage door and came to rest after crashing through the back wall of the house, fire officials report. The vehicle caused some damage to the home but did not hit any support beams. A wrecker was called to remove the vehicle and the family has been allowed to stay in the house, but was advised to avoid the garage. No one was harmed.
